Terms of Service for OneClickSWMS

1. Acceptance of Terms

By creating an account, accessing, or using the OneClickSWMS platform at https://oneclickswms.com.au ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

During the account creation process, you will be required to tick a checkbox confirming that you have read and agree to these Terms before your account is activated.

2. Description of Service

OneClickSWMS is an AI-assisted tool that helps users generate, edit, share, and collect digital signatures on Safe Work Method Statements (SWMS) for Australian construction and related industries.

OneClickSWMS is a productivity tool. It is:

  • NOT a workplace health and safety consulting service
  • NOT professional WHS advice
  • NOT a substitute for qualified safety professionals

AI-generated content produced by the Service is intended as a starting point only. All AI-generated SWMS content must be reviewed, customised, and verified by a competent person for the specific workplace before use.

3. PCBU Responsibility & WHS Compliance

The Person Conducting a Business or Undertaking (PCBU) retains full, non-delegable responsibility for ensuring that any SWMS produced using the Service meets the requirements of applicable Work Health and Safety legislation.

Using OneClickSWMS does not transfer, reduce, or satisfy the PCBU's primary duty of care under the Work Health and Safety Act 2011 (Cth) or equivalent state and territory legislation.

The PCBU must:

  • Review all AI-generated content for accuracy and site-specific conditions
  • Develop SWMS in consultation with workers as required by law
  • Ensure SWMS are adequate for the specific workplace, tasks, and hazards involved
  • Not rely solely on AI-generated output

4. AI-Generated Content Disclaimer

Content generated by AI within the Service is produced using machine learning models and may contain errors, omissions, or inaccuracies. AI-generated content should not be relied upon without independent review by a qualified person.

We do not warrant that AI-generated content is accurate, complete, current, or suitable for any particular purpose. AI output does not constitute professional advice of any kind, including but not limited to workplace health and safety advice, legal advice, or engineering advice.

5. Subscription Terms

OneClickSWMS offers monthly subscription plans ranging from $15 to $60 per month (AUD). All payments are processed securely via Stripe.

  • Subscriptions include a set number of AI generation credits per billing cycle, as specified in your chosen plan.
  • Unused AI generation credits do not roll over to the next billing cycle.
  • We may change subscription pricing with at least 30 days' written notice before your next billing cycle.

6. Refund & Cancellation Policy

  • No refunds are provided for change of mind.
  • Used AI generation credits are non-refundable.
  • You may cancel your subscription at any time through your account settings or via our billing portal.
  • Upon cancellation, you retain access to the Service until the end of your current billing period.

Nothing in these Terms limits your rights under the Australian Consumer Law, including your right to a remedy (repair, replacement, or refund) if the Service fails to meet a consumer guarantee.

7. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

Nothing in these Terms purports to modify, restrict, or exclude any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

8. Digital Signatures

OneClickSWMS facilitates the collection of digital signatures on SWMS documents. The platform records signer details, timestamps, and IP addresses for each signature.

While electronic signatures are recognised under the Electronic Transactions Act 1999 (Cth) and equivalent state and territory legislation, we do not guarantee that any particular signature collected through the Service will be accepted as legally valid in any specific context.

It is the PCBU's responsibility to ensure that signatures collected through the Service meet applicable legal requirements for their intended purpose.

9. User Responsibilities

As a user of OneClickSWMS, you agree to:

  • Maintain the confidentiality of your account credentials
  • Use the Service in compliance with all applicable laws and regulations
  • Ensure all information you provide is accurate and up to date
  • Review and verify all AI-generated content before use on any worksite
  • Not use the Service for any unlawful purpose

10. Data & Privacy

We collect personal information as described in our Privacy Policy. We do not sell your data. Data is stored on servers located in Australia.

11. Intellectual Property

The OneClickSWMS platform, software, branding, and original content are owned by us and are protected by applicable intellectual property laws.

SWMS documents and other content you create using the Service are owned by you. You grant us a limited licence to store and process your content solely for the purpose of providing the Service to you.

12. Limitation of Liability

To the maximum extent permitted by law (but subject to the Australian Consumer Law section above):

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total aggregate liability for any claims arising from or related to the Service is limited to the fees you have paid to us in the 12 months preceding the claim.
  • We are not liable for any loss, damage, injury, or death arising from reliance on AI-generated content that has not been reviewed and verified by a competent person.
  • We are not liable for any workplace incidents, regulatory penalties, or enforcement actions arising from the use of SWMS generated through the Service.

13. Indemnification

You agree to indemnify and hold harmless OneClickSWMS, its owner, and its affiliates from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from:

  • Your use of AI-generated content without proper review and verification by a competent person
  • Your failure to comply with WHS legislation
  • Any workplace incidents related to SWMS you created or modified using the Service
  • Your breach of these Terms

14. Service Availability

We strive to provide reliable and continuous service but do not guarantee uninterrupted availability. We may perform scheduled maintenance, updates, or modifications to improve the Service.

We are not liable for any temporary service interruptions, including those caused by maintenance, technical issues, or circumstances beyond our reasonable control.

15. Termination

We may suspend or terminate your account if you:

  • Breach these Terms
  • Engage in fraudulent activity
  • Fail to make required subscription payments

You may terminate your use of the Service at any time by cancelling your subscription and ceasing use of the platform.

16. Dispute Resolution

If you have any concerns or issues relating to the Service or these Terms, please contact us at support@oneclickswms.com.au. We will work with you in good faith to resolve any issue. OneClickSWMS provides access to a technology platform, and all decisions regarding account issues, refunds, or service access are final once communicated.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales and the Commonwealth of Australia.

18. Changes to Terms

We may update these Terms from time to time. Material changes will be notified to you via email at least 14 days before they take effect.

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.
