Terms of Service

The short version

  • You pay for credits or a plan. A credit is used when you finalise a SWMS.
  • Bought credits never expire while we run OneClickSWMS. Plan credits refresh each renewal.

  • AI drafts need your review. You stay responsible for your SWMS.

1. Who we are and who these Terms are for

1.1 OneClickSWMS is operated by Varun Prasad Gopisetti, a sole trader (ABN 53 930 169 401), NSW, Australia ("we", "us"). Contact: support@oneclickswms.com.au.

1.2 These Terms apply when you create an account, buy credits or a plan, or use OneClickSWMS (the "Service"). You accept them by ticking the box when you sign up or pay.

1.3 OneClickSWMS is for businesses. To hold an account you must be 18 or older and use the Service for a business (including as a sole trader). If you sign up for a business, you confirm you can accept these Terms for it.

1.4 Workers who open a sign-off link don't need an account. Section 11 and our Privacy Policy explain how we handle their details.

2. What OneClickSWMS does — and doesn't do

2.1 OneClickSWMS helps you draft, edit, share and keep Safe Work Method Statements (SWMS), and collect electronic sign-offs from workers.

2.2 It uses AI models from third-party providers to draft content from what you type or say. Requests go through Vercel AI Gateway with zero data retention on every call. Today the drafting providers are Google (Vertex AI) and Anthropic, and the voice providers are Google (Vertex AI) and xAI. Drafts can be wrong, incomplete or unsuitable for your site.

2.3 OneClickSWMS is a software tool. It is not a WHS consultant, doesn't inspect your site, doesn't give legal or WHS advice, and doesn't make a SWMS compliant with any law.

3. Your responsibilities for your SWMS

3.1 The business doing the work (the PCBU, or in Victoria the employer or self-employed person) is responsible for its SWMS under the WHS/OHS laws of its state or territory. Using OneClickSWMS doesn't change or reduce that responsibility.

3.2 Before high-risk construction work starts you must: check the SWMS fits the job and the site; consult the workers doing the work; make sure they can read and access it; make sure work follows it; and review it when things change.

3.3 You must keep your SWMS for as long as the law requires. We keep your records as set out in section 13, but you should also download your own copies.

4. AI-generated content

4.1 AI drafts are a starting point. You must review, edit and approve every SWMS before you use it. When you finalise a SWMS you confirm you have reviewed it.

4.2 We take reasonable care in building, testing and reviewing our templates and AI instructions, and we work to correct errors we find or that are reported to us. We don't promise that any AI output is accurate, complete or suitable for your site.

4.3 Don't include personal details (names, phone numbers, health information) in job descriptions or voice recordings.

5. Your account

5.1 You sign in with a one-time code sent to your email, or with Google. Keep access to your email secure; you're responsible for activity in your account unless it results from our failure to take reasonable care.

5.2 Tell us straight away if you think someone else has accessed your account.

6. Credits

6.1 You need credits to finalise a SWMS. A standard SWMS uses 1 credit, a complex SWMS 2 credits and a job pack 3 credits, using the rules shown on our pricing page. The editor shows the cost before you confirm, and no credit is used until you confirm.

6.2 Drafting and previewing are free for accounts with credits or a plan, within a fair-use limit shown in the app. A credit is used the first time you finalise a draft (by publishing it, downloading it or sending it to workers). Viewing, downloading again, editing, revising and collecting sign-offs on a finalised SWMS don't use more credits.

6.3 If a draft or finalise fails because of a fault on our side, no credit is used; if one was used, we put it back.

6.4 One-off credits (packs of 1, 3 or 10) don't expire while we operate OneClickSWMS. They can't be exchanged for cash or moved to another account. If we decide to stop providing the Service, we'll give you at least 90 days' notice and refund the price of your unused one-off credits. If we refund a pack for any other reason, its unused credits are removed.

6.5 Plan credits come with a monthly or yearly plan. They refresh on each renewal date and unused plan credits don't carry over. Plan credits are used before one-off credits.

7. Subscriptions (monthly and yearly plans)

7.1 Monthly and yearly plans are subscriptions. The price, what's included and how to cancel are shown next to the pay button before you subscribe.

7.2 Monthly: A$60 a month, 10 plan credits each month. Yearly: A$129 a year, 15 plan credits for the year. Prices are in Australian dollars.

7.3 Plans renew automatically at the end of each period at the same price (or a new price we have notified under section 8) until you cancel.

7.4 We email yearly subscribers at least 30 days before each renewal, and monthly subscribers at least every 6 months, with a summary and a link to cancel. These emails go to your account email address. If one doesn't reach you, you can still see your renewal date and cancel at any time in Billing.

7.5 You can cancel online at any time in Billing — no notice needed. Your plan then ends at the end of the period you've paid for and you won't be charged again. One-off credits and your records stay.

7.6 If you move from monthly to yearly, the yearly plan starts straight away and we take the unused part of your current month off the yearly price. If you move from yearly to monthly, the change happens at your next renewal date.

7.7 If a payment fails, Stripe will retry and we'll email you. If it still fails, your plan ends; your records and one-off credits stay.

8. Changes to plans and prices

8.1 We may change a plan's price or what it includes, or stop offering a plan. We'll email you at least 30 days before the change affects you.

8.2 A price change applies only from your next renewal after the notice period. If you don't want it, cancel before then and you won't be charged the new price. We will never move you to a new plan or a higher price unless you choose it.

8.3 During a yearly period you've already paid for, we won't reduce what your plan includes. If we stop offering a yearly plan, we'll keep providing it until your paid year ends; if we can't, we'll refund the unused whole months.

8.4 Changes to credit packs don't affect credits you've already bought.

9. Refunds

9.1 We don't give refunds if you change your mind. We do refund when we're at fault — for example a duplicate charge, a charge after you cancelled, or a service we couldn't provide — and whenever the Australian Consumer Law requires it. See our Refund Policy.

10. Payments and tax

10.1 Payments are processed by Stripe. Charges show on your statement as ONECLICKSWMS.

10.2 We're not registered for GST, so we don't charge GST. If we become registered, prices will include GST. If that changes what you pay for a plan, section 8 applies (at least 30 days' notice before a renewal at the new price, and you can cancel).

10.3 Please contact us before disputing a charge with your bank — we'll fix genuine errors.

11. Workers and sign-offs

11.1 You can share a SWMS with workers by link, QR code, the share sheet on your phone, or email from the app. Workers can read and sign without an account.

11.2 You must only invite people who work on your jobs, and only use email addresses you have for that purpose. You're responsible for telling your workers why you ask them to sign.

11.3 When a worker signs, we record the name they enter, the SWMS version, the time, how the link reached them, and technical details such as IP address and device. We don't verify who they are.

11.4 No WHS law requires workers to sign a SWMS. A sign-off is a record that the worker was given the SWMS and said they understood it. It doesn't replace consultation, training or supervision.

11.5 Workers agree, when they sign, that their details and signature are shared with you. Use them only for your WHS records and the job.

12. Emails we send for you

12.1 When you send an invite or reminder, we email the worker on your behalf, naming your business. We limit reminders and honour opt-outs. If a worker opts out, share the link another way.

13. Your records

13.1 You own the content you put into OneClickSWMS and the SWMS you create, as between you and us. You give us a limited licence to store and process it only to provide, secure and support the Service. We don't use your content or your workers' details to train AI models, and every AI request goes through Vercel AI Gateway with zero data retention, so our AI providers don't keep it or use it to improve their models.

13.2 While your account is open, we keep your SWMS, PDFs and sign-off records and you can view, download and export them at no charge, whether or not you have credits or a plan. QR codes and links you've shared keep working while we operate the Service, unless you turn them off. Sections 13.4 and 13.5 explain when records are deleted.

13.3 We may remove or de-identify information where the law requires it, where a person whose information it is makes a request we must act on, or to protect security.

13.4 If you close your account, we keep your records for 90 days so you can change your mind or download them, then we delete them and can't restore them. Download anything you still need to keep under WHS laws before you close.

13.5 If we decide to stop providing the Service, we'll give you at least 90 days' notice and a way to download everything.

14. Privacy

14.1 Our Privacy Policy explains how we handle personal information, including where our service providers process it (some are overseas).

15. Acceptable use

15.1 Don't: use the Service unlawfully; upload content you don't have the right to use; try to access other people's data or links; overload, probe or reverse-engineer the Service; use it to send spam; or misrepresent a SWMS as approved by us or a regulator.

16. Our intellectual property

16.1 The OneClickSWMS software, templates, branding and website content belong to us. Some content is produced with generative AI, so we don't promise that any output is unique or free from third-party rights.

17. Availability and changes to the Service

17.1 We aim to keep the Service available but can't promise it will be uninterrupted. We may change features to improve the Service. If a change materially reduces what you paid for, you can cancel, and we'll refund the unused whole months of a yearly plan and the price of any one-off credits you can no longer use.

18. Australian Consumer Law and our liability

18.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or changes those guarantees or your rights and remedies under them.

18.2 Because OneClickSWMS is a business tool and not a service ordinarily bought for personal or household use, to the extent the law allows, if we fail to meet a consumer guarantee our liability is limited to supplying the service again or paying the cost of having it supplied again. This limit doesn't apply if it would not be fair or reasonable for us to rely on it.

18.3 Subject to 18.1 and 18.2, and to the extent the law allows, we are not liable for loss that arises because a SWMS was used without the review and consultation described in section 3, or from things we don't control (your site, your workers, your supervision). Each of us remains responsible for loss to the extent it's caused by our own acts or omissions.

18.4 Subject to 18.1 and to the extent the law allows, each party's total liability to the other under or in connection with these Terms is limited to the greater of A$1,000 and the amount you paid us in the 12 months before the claim. This limit doesn't apply to your obligation to pay for the Service, to liability for fraud, to personal injury or death caused by negligence, or to anything the law says can't be limited.

19. Indemnity

19.1 To the extent the law allows, you're responsible for loss we suffer because of your unlawful use of the Service or your deliberate or reckless breach of these Terms. This doesn't cover loss caused by our breach, our negligence, or anything the law says can't be excluded. This indemnity doesn't cover any fine or penalty under work health and safety laws.

20. Suspension and closing accounts

20.1 We may suspend or close an account for serious or repeated breach, fraud, or non-payment. Unless urgent action is needed for security, safety or legal reasons, we'll tell you first and give you a reasonable chance to fix the problem. Where we can lawfully do so, we'll let you download your records before closing.

20.2 You can stop using the Service and close your account at any time.

20.3 We may transfer our rights and obligations under these Terms to a company we control, or to a buyer of the OneClickSWMS business, if your rights aren't reduced. We'll tell you by email at least 30 days before, and you can cancel and get a refund of the unused whole months of a yearly plan and the price of your unused one-off credits.

21. Complaints and disputes

21.1 Contact us first at support@oneclickswms.com.au. We'll acknowledge you within 2 business days and try to resolve it within 10 business days. Nothing here limits your rights to go to a regulator or a court.

22. Changes to these Terms

22.1 We may update these Terms. For changes that could disadvantage you, we'll email you at least 30 days before they take effect and ask you to accept them in the app. If you don't accept, your current Terms continue until the end of your paid period, your plan won't renew, and we'll refund the unused whole months of a yearly plan; your records stay available under section 13. Changes that don't disadvantage you (such as clarifications or new optional features) take effect when we publish them.

23. Law

23.1 These Terms are governed by the laws of New South Wales and the Commonwealth. This doesn't take away protections the law of your state gives you.

25. Notices

25.1 We give notices by email to your account email address and in the app. Keep your email address up to date. You can give us notice at support@oneclickswms.com.au.

26. Severability

26.1 If a court decides part of these Terms is void or unenforceable, the rest continues to apply.
